Montessori Learnworld – General Terms and Conditions (GTC)

§ 1 Scope and Provider

1.1 These General Terms and Conditions (GTC) apply to all orders placed through the online shop of Montessori Learnworld (hereinafter referred to as “Provider”).

1.2 Deviating terms and conditions of the customer will not be recognized unless their validity is expressly agreed to in writing.

1.3 The product offering is exclusively aimed at consumers within the meaning of § 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.

§ 2 Conclusion of Contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.

2.2 By clicking the button “Buy now”, the customer makes a binding purchase offer.

2.3 The provider accepts the order either by sending an order confirmation by email or by delivering the goods within 2 working days.

2.4 The customer receives an order confirmation by email immediately after ordering. Processing and shipping usually take place within 1–3 working days after receipt of payment.

2.5 Cancellations are only possible within 24 hours after the order. After that, the regular processing and shipping process begins, so a cancellation can no longer be considered.

§ 3 Prices and taxes

3.1 All prices on the website are net prices excluding taxes. The applicable value-added tax will be added and displayed during the checkout process.

3.2 The prices at the time of the order apply.

§ 4 Shipping costs and delivery

4.1 Delivery is made to the countries that can be selected in the online shop.

4.2 No shipping costs will be charged for all deliveries.

4.3 If not all ordered products are available, the provider is entitled to partial deliveries, as long as this is reasonable for the customer.

4.4 The delivery time is usually 7–15 working days, depending on the destination country.

§ 5 Payment terms

5.1 The following payment methods are available in the online shop:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • Google Pay
  • Apple Pay

5.2 Payment is due immediately upon conclusion of the contract.

§ 6 Right of withdrawal

6.1 Consumers have a statutory right of withdrawal of 14 days.

6.2 Details are regulated in the cancellation policy, which is available on a separate page.

6.3 A return is only possible after receipt of the goods and must be made in accordance with the cancellation policy.

6.4 The customer is obliged to ensure, before placing the order, that all information (delivery address, product variants, etc.) is correct to avoid unnecessary returns and delays.

§ 7 Retention of title

The goods remain the property of the provider until full payment is made.

§ 8 Warranty

The statutory rights of liability for defects apply.

§ 9 Liability

9.1 The provider is fully liable in cases of intent and gross negligence.

9.2 In cases of simple negligence, the provider is only liable for damages resulting from the breach of essential contractual obligations (cardinal obligations), limited to foreseeable damage.

9.3 Liability for damages resulting from injury to life, body, or health remains unaffected.

§ 10 Online dispute resolution

The EU Commission provides a platform for online dispute resolution (ODR):

The provider is not obliged and not willing to participate in dispute resolution procedures before a consumer arbitration board.

§ 11 Final provisions

11.1 The law of the Federal Republic of Germany shall apply, excluding the UN Sales Convention.

11.2 If individual provisions of these GTC are ineffective, the effectiveness of the remaining provisions shall remain unaffected.
